Who pays for vehicle damage from potholes once PFI starts?

Many drivers may not be aware that if your car is damaged due to potholes or road defects, you can claim compensation for the damage.

Some residents on the Isle of Wight have previously reported that potholes have caused several £100s of damage to their vehicles, so making a compensation claim was a ‘no brainer’.

Cowes resident Thomas Cowley got in touch with OnTheWight sharing details he’d asked the council in relation to compensation claims.

He was interested to know once the Highways PFI scheme was in place (1st April 2013) who would pay out for damage caused by road defects.

Island Roads will consider claims
Cllr Edward Giles says, “Claims for vehicle damage sustained after the service commencement date of the Highways PFI contract will be subject to consideration by Island Roads.

“Island Roads will manage and process these claims and liability will be ascertained dependent on the circumstances of the individual case. Where it is the case that the damage has been sustained due to a road defect then it will be the responsibility of Island Roads to meet that claim.

“Island Roads will have a Website in place from the service commencement date which the public can use to log issues to be actioned.”

Back in 2011, the Isle of Wight council saw a huge increase in the number of claims for compensation due to damage caused by potholes.

i would be inclined to photograph the pothole and include a picture in with your claim

You also need to place an object, like a 50 pence piece in the pothole to give an idea of scale

This information was posted on the Island Independents’ Facebook page on Tuesday 19th in response to a question from a constituent in East Cowes on the 14th March. I personally contacted the legal department and the Island Roads PR team to come up with an answer almost word perfect to that given subsequently by Edward Giles.

Will they process claims on sections of the road that they have not completed works on? If so I guess they are taking on a considerable liability from IWC? Is this priced into the deal or will each claim be an ‘extra’ that is then charged back to IWC?

Success in getting getting compensation out of IWC insurers for personal damages caused by the state of Island roads and footpaths is as likely as the ferry companies reducing their prices. (I speak from personal experience!)

Transferring the responsibility to the privatised Island Roads company will not improve the situation.

My car just needed a new back shock for its MOT. The poor old thing has done most of its mileage on the Island. It can’t be the only one to suffer badly.
Unfortunately, you don’t have the remotest chance claiming for vastly increased wear and tear. If you blow out a tyre on a pothole and photograph it, you may at least be in luck…

Had my MOT today – more bushes to change and problems with offside/nearside steering rack inner joints. Have spent around £750 on wheel/steering/suspension related issues this year.
