Anyone interested in the future of the Le Veness site on Ventnor seafront should read on.
Next Tuesday (21st December) the Planning Committee will be considering a recommendation from planning officer Stephen Wiltshire to approve a Certificate of Lawful Development for the site.
Any members of the public wishing to speak at the committee (the public are allowed three minutes to make a statement) need to get in touch with Public Speaking Administrator by 5pm on Thursday 16/12/2010, to register.
Full details of the recommendation can be found in the report going to the Planning Committee.
Background
Many years ago, planning permission was granted (under delegated powers) to develop a six-storey building of flats on Ventnor seafront.
Just before the planning permission ran out last July (2009), work started on the site, but it was quickly stopped by the local planning authority (LPA) as certain conditions had not been met.
The developers appealed against the decision and earlier this year an inquest was held at County Hall where both sides gave evidence.
The Planning Inspector dismissed the appeal on the basis that the information submitted was insufficient to comply with the requirements of Condition 2 attached to the planning permission.
Since then the developer has applied for a Certificate of Lawful Development and the planning officer is now saying that they must grant approval.
The Local Planning Authority concludes that Condition 2 attached to planning permission P/02364/02 does not constitute a condition precedent. Therefore the operations undertaken on the site during July 2009 do constitute a lawful commencement of this planning permission and the approved development can thus be built out.
We hope to add to this when we have more time.
