Mr Cornwell (planning) – being asked to alter conditions.

1st – condition 14 – completion of a legal agreement – open toilet, cafe, harbour masters office.

Request from applicant to delete the requirements for harbour masters office and cafe. In the view of planning removing this would take away a fundamental building block of this agreement.

Cond 15 – Access route to the site to be complete before the building is started. Have taken advice from consultees.

Due to H&S the road will need to be closed

We think it would be a good idea to vary this condition.

Change wording using a split decision. Refuse the first, reject the second.

Further element – Due to an oversight (at officer level), it was there as a general agreement

Discussion with the developers – Willing to accept corrected terms.

Wish to provide full support to the planing officers and their report.

Agree that cafe is not vital – be better if it should be chandlery

Sections 106 should be signed before start of building

Cllr Scoccia – it’s all been said by the officers and Prof Russell.

Questions – Is there anything that stops the cafe and harbour master office being sublet to another party.
BB – No, that’s outside planning scope.

Cllr Miller – Concerned that conditions that have been passed by councillors are missed off by officers. Would like assurance from Mr Murphy that it won’t happen again.

Mr Murphy – It’s my memory that the condition was explicit. We are sorry for the error and are looking at the process how we put together notices following a committee.

Chair – It’s still fresh in your minds as we’ve recently dealt with it. Guidance is clear from the officers.

Clr Mosdell – What category does Marine use fall into? B1, B2, B3, etc. Would they be able to build taxi’s for example.

Mr Pegram – Unless their water taxi’s – No. (laughter all round)

Recommendation is to permit start of building at same time as highways and refusal to change condition 14.

Refuse to vary Condition 14 on P/02013/06 for the following reason:
To delete all references of land uses other than the provision of toilet and shower facilities for Ventnor Haven users from Condition 14 of planning permission P/02013/06 would not be in accordance with the mixed use ethos for this building and therefore would be contrary to the aims of the Ventnor Esplanade Development Brief.
