The Isle of Wight Council has confirmed that many of the 19 remedial actions outlined in their pre-Section 215 enforcement letter to Ventnor Winter Gardens owner remain outstanding.
The process began in April 2025 when Kevin Sussmilch of Wight House Limited (the dormant company that signed the contract with the Isle of Wight council) was served with the initial letter requiring extensive improvements to the building and grounds.
The council granted 16 weeks for completion of works (25th July 2025) including cleaning elevations, repairing render, repainting surfaces, replacing broken glazing and clearing rubbish from the site.
Some progress made on western elevation
The council acknowledges that some improvements have occurred, particularly focusing on the building’s western elevation.
However, the authority states that “the full scope of actions outlined in the pre-Section 215 letter has not yet been completed.”
Officers continue monitoring the venue’s condition while, they say, maintaining dialogue with the landowner.
Council requests updated survey information
The planning authority has requested fresh survey information from the property owner to determine the next appropriate steps.
The council says it maintains an active pre-enforcement process regarding the historic Ventnor venue.
Officials describe their current approach as “proportionate and focused on securing voluntary compliance wherever possible”.
Enforcement action remains under consideration
For the time being, officials say that formal Section 215 notice proceedings would be considered “disproportionate” given the partial progress achieved and ongoing owner engagement.
They say officers will continue monitoring the situation, whilst encouraging voluntary completion of outstanding works.
Should progress stall or the building’s condition deteriorate further, the council told OnTheWight that enforcement options will be reconsidered.
Council representative to attend public meeting
Natasha Dix, Service Director for Waste, Environment and Planning, will attend tonight’s public meeting at Better Days Cafe (Monday from 6pm).
The meeting gives an opportunity for residents to discuss the Winter Gardens situation directly with council officials.
Local interest in the venue’s future remains high given its significance to Ventnor’s heritage and tourism prospects.
